Arrears usually stem from a benefit delay, a change in circumstances or a payment error rather than refusal to pay. Courts expect landlords to have engaged before seeking possession, and a documented attempt to resolve matters strengthens any later claim.
Practical guidance
- Send a clear, dated statement showing every payment and the outstanding balance.
- Offer a written repayment plan and record whether the tenant accepts it.
- Ask whether an Alternative Payment Arrangement can direct Universal Credit housing costs to you.
