Overview

A guarantor agreement should state exactly what is guaranteed — rent, damage, or both — the maximum liability, and how long the guarantee lasts, including whether it continues into a periodic tenancy. Vague guarantees are hard to enforce.

Practical guidance

  • Have the guarantor sign a separate document, not just a line on the tenancy.
  • State clearly that the guarantee continues after the fixed term ends, if that is intended.
  • Reference the guarantor for affordability as you would a tenant.
