Overview

Every private let in Scotland that started on or after 1 December 2017 is a Private Residential Tenancy. It is open ended, has no fixed term, and must include the Statutory Terms. Why it matters

Landlords must give tenants written terms within 28 days of the tenancy starting, along with the Statutory Terms Supporting Notes. Missing terms can lead to a Tribunal award of up to six months rent.

Legal requirements

  • Include all Statutory Terms from the 2017 Statutory Terms Regulations.
  • Provide written terms within 28 days of the start date.
  • Protect the deposit within 30 working days and give the prescribed information.
  • Meet the Repairing Standard, including EICR, gas safety and interlinked alarms.

Common mistakes

  • Using an English assured tenancy template in Scotland.
  • Including a fixed term or break clause, which has no effect in a PRT.
  • Leaving out the landlord registration number.
  • Not giving the Supporting Notes.
