Overview
Serving the statutory pack is only half the job — being able to prove you served it is what protects you months or years later.
Why it matters
Disputes about whether an EPC or gas safety record was ever given are common, and the burden of proof sits with the landlord.
Legal requirements
- Provide a valid Energy Performance Certificate.
- Provide the current Gas Safety Record where there is a gas supply, within 28 days of the check.
- Provide the Electrical Installation Condition Report within 28 days of the inspection.
- Provide the current government guidance for tenants.
Common mistakes
- Emailing documents with no acknowledgement.
- Serving an expired gas record or EICR.
- Forgetting to re-serve the gas record after each annual check.
Practical guidance
- Get a signature or an email confirmation on the day.
- Store the receipt with the agreement.
- Re-serve and re-record every time a certificate is renewed.
