Overview

Arrears are rent that is overdue. They matter both commercially and legally: the mandatory arrears ground for possession under the reformed regime requires three months' (or 13 weeks') arrears both at the date of the notice and at the hearing, with a four-week notice period.

Legal requirements

  • Serve notices only when the arrears threshold is genuinely met on both dates.
  • Universal Credit payment delays do not stop arrears accruing but the court will hear the explanation.

Practical guidance

  • Send a polite written reminder as soon as rent is a few days late and keep a full rent statement.
  • Offer a written repayment plan — courts expect landlords to have tried.
