Company let

A tenancy granted to a business rather than an individual.

Overview

Where a property is let to a company for occupation by its employees, the tenancy is not assured — the Housing Act 1988 protections apply only where an individual occupies as their only or principal home. Company lets fall outside the assured regime, but deposit and safety rules and lender consent still need care.

Legal requirements

  • Company lets are not assured tenancies, so the reformed possession grounds do not apply.
  • Deposit protection rules do not apply to non-assured tenancies, but contractual protection is still sensible.

Practical guidance

  • Do not use a company let as a device to avoid tenant protections — courts look at the substance.
