Overview

The Homes (Fitness for Human Habitation) Act 2018 requires rented homes to be fit for human habitation at the start of and throughout the tenancy. Tenants can sue directly for an order requiring works and for damages, without needing the council to act.

Legal requirements

  • Fitness is assessed against factors including damp, ventilation, water supply, drainage, stability and HHSRS hazards.
  • The duty applies for the whole tenancy, not just at the start.

  • Respond to disrepair reports in writing with a plan and dates — silence is what escalates claims.
