Guarantor

A third party who agrees to cover the tenant's obligations.

Overview

A guarantor promises to pay rent and other liabilities if the tenant does not. Guarantee agreements should be in a deed, clearly cover the periodic tenancy for as long as it continues, and be signed before the tenancy starts. Guarantors are common for students and tenants with thin credit files.

Legal requirements

  • A guarantee for future obligations should be executed as a deed to be enforceable.
  • In a joint tenancy, make clear whether the guarantee covers the whole rent or one share.

Practical guidance

  • Reference and ID-check the guarantor and give them a copy of the tenancy agreement.
