Overview

Harassment covers acts likely to interfere with a tenant's peace or comfort in order to make them leave — cutting off utilities, removing doors, repeated unannounced visits or threats. Illegal eviction is removing an occupier without a court order. Both are criminal offences and can also lead to substantial civil damages and a rent repayment order.

Legal requirements

  • Prosecution is brought by councils; civil claims for damages run alongside.
  • Even where the occupier has no written agreement, notice and court process are usually required.

  • Never change locks, remove belongings or stop services to force someone out — always use the court route.
