Joint and several liability

Each joint tenant is liable for the whole rent, not just their share.

Overview

In a joint tenancy every tenant is individually responsible for all the rent and for damage, so a landlord can pursue any one of them for the whole amount. It is the standard arrangement for couples and sharers who take a single tenancy.

Legal requirements

  • One joint tenant's valid notice can end the whole tenancy for everyone.
  • A replacement sharer normally requires a new tenancy or a deed of assignment.

Practical guidance

  • Explain joint and several liability to sharers in writing before they sign — it prevents disputes later.
