Overview

Nuisance covers noise, waste, aggressive behaviour and other conduct affecting others. It is both a breach of the tenancy agreement and a possession ground, and councils have separate statutory nuisance powers against the landlord if the property itself is the cause.

  • Statutory nuisance abatement notices can be served on landlords under the Environmental Protection Act 1990.

Practical guidance

  • Write to the tenant early, set out the specific incidents and keep the correspondence for court.
