Overview
A possession order specifies the date by which the tenant must leave. It may be outright or suspended on terms — typically payment of current rent plus an amount off the arrears. If the tenant stays past the date, the landlord applies for a warrant of possession.
Legal requirements
- A possession order alone does not permit eviction — only a bailiff or HCEO may evict.
- Money judgments for arrears and costs can be made in the same order.
Practical guidance
- Check the order for the exact date and any suspension terms before taking any further step.
