2 min read · Updated 2 August 2026
Overview
Ground 8A allows possession where the tenant has been in at least two months' arrears on at least three separate occasions within a three-year period, targeting persistent late payers who clear arrears just before a hearing. It sits alongside the reformed serious arrears ground requiring three months' arrears.
Legal requirements
- The arrears history must be evidenced by a full rent account.
- Notice periods and thresholds are set out in Schedule 2 of the Housing Act 1988 as amended.
Practical guidance
- Keep a clean, dated rent ledger from day one — it is the evidence the court relies on.
