Subletting
A tenant letting all or part of the property to someone else.

Overview
Subletting creates a new tenancy between the tenant and a sub-tenant while the original tenancy continues. Most agreements prohibit it without consent; unauthorised subletting is a breach of contract, a possession ground, and can create an unlicensed HMO or invalidate insurance.
Legal requirements
- Unauthorised subletting of a whole social or private home may also be a fraud offence.
- Consent, if given, should be in writing and conditional.
