Surrender

Ending a tenancy by agreement rather than by notice.

2 min read · Updated 2 August 2026

Overview

Surrender ends the tenancy when the tenant gives up possession and the landlord accepts it. It can be express, by deed, or implied by conduct such as returning the keys and the landlord re-letting. Getting it recorded avoids disputes about ongoing rent liability.

Legal requirements

  • Accepting keys and re-letting can amount to surrender by operation of law.

Practical guidance

  • Record the agreed end date, final rent, deposit position and meter readings in writing.
