Overview
The Tenant Fees Act 2019 bans all payments to landlords and agents except rent, a capped deposit, a capped holding deposit, tenant-requested variations, early termination costs, utilities and council tax, and default fees for lost keys or late rent within strict limits.
Legal requirements
- Deposits are capped at five weeks' rent (six weeks where annual rent is £50,000 or more).
- Late rent default fees are limited to interest at 3% above base, and only after 14 days.
Practical guidance
- Refund any prohibited payment immediately — you cannot serve a valid possession notice until you do.
