Overview
Referencing typically covers identity, right to rent, employment or income, affordability, previous landlord reference and a credit check. It must be applied consistently to all applicants — blanket bans on benefit claimants or families are unlawful.
Legal requirements
- Data collected must be handled in line with UK GDPR and kept no longer than necessary.
- Refusals based on benefits or children are unlawful under the Renters' Rights Act 2025.
Practical guidance
- Use an affordability ratio, not a source-of-income rule, and record your reasoning.
