Tenant referencing

Checks on an applicant's identity, income and history.

Overview

Referencing typically covers identity, right to rent, employment or income, affordability, previous landlord reference and a credit check. It must be applied consistently to all applicants — blanket bans on benefit claimants or families are unlawful.

Legal requirements

  • Data collected must be handled in line with UK GDPR and kept no longer than necessary.
  • Refusals based on benefits or children are unlawful under the Renters' Rights Act 2025.

Practical guidance

  • Use an affordability ratio, not a source-of-income rule, and record your reasoning.

This wiki entry is general information for UK landlords and letting agents, not legal advice. Rules differ across England, Wales, Scotland and Northern Ireland — check your local requirements or take advice before acting.
