Zoning and use class C4
Planning rules that affect small HMOs.
2 min read · Updated 2 August 2026
Overview
A small shared house for three to six unrelated people falls in planning use class C4. Conversion from a family home (C3) is normally permitted development, but where the council has made an Article 4 direction, full planning permission is required — a separate issue from HMO licensing.
Legal requirements
- Article 4 directions remove permitted development rights in designated areas.
- Larger HMOs above six people are sui generis and always need planning permission.
Practical guidance
- Check the council's Article 4 map before buying a property intended for shared occupation.
